Information and Communication Technologies [No. 15 of 2009 137 PART IV LICENCING OF RADIOCOMMUNICATION SERVICES 27. (1) This Part applies to radiocommunications. In this Part, licensee " means a holder of a licence under this Part. Application of Part The provisions of this Part and of the Convention shall not apply to the Zambia Police Force or the Defence Force except in so far as they relate to— the establishment of transmitting stations and the erection of radio station apparatus at permanent sites; the allocation of frequencies by the Authority; migration from existing frequency bands following frequency spectrum band re-planning by the Authority; the approval of the Authority of the mode of transmission to be used in connection with radio transmitting stations and the power to be radiated therefrom; (e) the prevention of harmful interference; (B distress calls, messages and signals; and (g) the manner of carrying on radiocommunication services governed by the provisions of the Convention. (1) Except as otherwise provided under this Part, a person shall not establish and operate a radio station or provide a radiocommunication service without a licence. (2) A person who contravenes subsection (1) commits an offence and is liable, upon conviction, to a fine not exceeding five hundred thousand penalty units or to imprisonment for a period not exceeding five years, or to both. Prohibition of operating radio station, etc. without licence (1) A person intending to establish and operate a radio Application station or to provide a radiocommunication service shall apply to for licence the Authority for a licence in the prescribed manner and form upon payment of the prescribed fee. The Authority shall. within sixty days of receipt of an application, grant or reject an application. The Authority shall, where it rejects an application, give the applicant the reasons for the rejection.
