3.2 . The appointment process for the members of the
regulating body is open, transparent and takes into
account the civil society.
ANALYSIS:
The process and mode for the appointment of HMC members is a
problem. According to article 184 of the constitution of 31 March
1996, this body comprises 9 members of which two are appointed by
the State President, one by the Speaker of the National Assembly,
one by the Senate President, three media professional appointed by
their peers, one judge appointed by the President of the Supreme
Court and one well known personality from arts and culture appointed by his peers. In reality such distribution makes it, in reality,
5 members appointed by the executive power (presidency), national assembly (the ruling party having the majority in parliament, the
senate which was abolished) and the Supreme Court, whose members are also appointed by the executive power. The only appointment that could be transparent is that of the media expert.
Decree 450 of 1995 about composition, assignments and functioning of HMC was amended by the law 19 of 24 October 2003. New
dispositions were introduced taking into account the amendment of
the constitution that included the abolition of the senate; minimum
requirement of five years of experience for experts who are interested in becoming members of HMC; organisation of the nomination
and election of the members to the HMC by the Ministry of Communication.
