SECTOR 3 3.1 Broadcasting legislation has been passed and is implemented that provides for a conducive environment for public, commercial and community broadcasting Mozambique does not have a broadcasting law; there has been a draft for more than 11 years but the process has never advanced to parliament. In November 2018, GABINFO promoted a seminar on the harmonisation of media sector legislation, but it is not known whether the proposals were finally submitted to parliament for discussion and approval. As already mentioned in other sections of the analysis of this Barometer, the aforementioned draft proposal for a broadcasting law was developed by GABINFO, in a process involving relevant entities or organisations such as the CSCS, the INCM, FORCOM, MISA-Mozambique, the SNJ and the ICS. In the absence of specific legislation, the broadcasting sector is regulated by general legislation – in particular, the Press Law and several regulations or ministerial diplomas from INCM and CSCS – leaving it, according to the panel, in a situation of extreme legal uncertainty and insecurity. In many cases, managers and other staff of entities such as GABINFO are the ones who care to “fill in” the law gaps, deciding as they wish. An example is the precarious licences for community radios which need to be constantly involved in quarterly renewal exercises.
