Broadcasting regulation is transparent and 			
independent; the state broadcaster is transformed
into a truly public broadcaster.

Broadcasting is regulated by an independent body 			
adequately protected against interference, particularly of 		
a political and economic nature.

Analysis
In Mali, there are two (2) regulatory bodies:
• The CNEAME (National Committee for Equal Access to State Media) created by organic law 93-001 in conformity with article
7 of the Constitution, which ensures the balance and plurality
of information. It is only functional during election periods and
does not have an institutional status.
• The Higher Communications Council (Act 92-038) which is a
purely consultative body. It has no powers and oversees the private sector rather than the public sector.
•
The method used to select its members does not guarantee the independence of these bodies.

The appointments procedure for members of the regulatory
body is open and transparent and involves civil society.

Analysis
The National Committee for Equal Access to State Media comprises
seven (7) members appointed by the President of the Republic, the
Prime Minister, the Speaker of the National Assembly, the Chief Justice of the Supreme Court, the Chief Justice of the Constitutional
Court, the Chairperson of the Higher Council of Local Governments,
and the Chairperson of the Economic, Social and Cultural Council.
