While journalists should be brought to account when actual damage is done with malicious intent, the damages awarded to the plaintiff are extremely high for a freelance journalist. There was, also, the case of musician Chama Fumba alias ‘Pilato’ who was arrested and taken to court over the production of a satirical song titled ‘Alungu Anabwela’. This case borders on freedom of expression but also relates to the media who are the channel of distribution of artist’s songs. Pilato was later acquitted but his song is still banned from the airwaves. This further gives credence for the call to decriminalize the freedom of expression in the Penal code which in its current state is not in standing with the modern dispensation or enjoyment of democracy. 7
