The editorial independence of the state/public
broadcaster from political influence is guaranteed by
law and practiced.
Because TVT is a state rather than a public service broadcaster, panelists were of
the opinion that the question of its editorial independence from political influence
does not even arise, either as a matter of law or in practice. There is no specific law
on state broadcasting on the statute books.
It should be noted, though, that the obligations of state/public radio and television
in editorial matters are spelt out by a presidential decree dated December 3, 1997.
According to article 22 of this statutory instrument, “the sociétiés de production
de programmes ensure the independence and pluralism of information as well as
the diverse expression of thought and opinion within the boundaries of the law”.
The text continues: “Programmes of any kind must not be one-sided or biased in
favour of one or several currents of thought or opinion. To this end, the national
programme societies will see to it that the principle of equal treatment is being
complied with, especially in programmes where positions are taken on political,
philosophical, religious or social issues.”
