Confidential sources are not protected by law and the courts can compel an
individual to disclose if that disclosure will serve the ‘public good’ or help to
determine the outcome of a particular case. So far, however, no court has made
such a ruling.
In practice, therefore, journalists can decide not to disclose their source of
information. This right should be backed up by a law which gives journalists the
same power that medical doctors and priests have not to disclose information
about their patients or members of their congregation.
Because the confidentiality of sources is not legally protected but in effect practised,
panelists differed quite considerably in their assessment and thus their scoring.
