Information and Communication Technologies [No. 15 of 2009 181 THIRD SCHEDULE (Section 4) TRANSITIONAL PROVISIONS 1. (1) Subject to the provisions ofthis section, all licences issued under the repealed Acts shall remain in force in accordance with the terms and conditions of such licences. The Authority shall, not later than sixty days from the commencement of this Act, publish or cause to be published in the print and electronic media, the standard terms and conditions for individual, class, network and service licences. As soon as reasonably practicable, but not later than six months from the commencement of this Act, the Authority shall issue one or more licences and, where applicable, one or more assignments, to any person who, at the commencement of this Act, holds a valid licence issued under the repealed Acts. (4) The terms and conditions of any licence or assignment issued by the Authority shall— include the terms and conditions published pursuant to subsection (2); be of the same duration as the unexpired portion of the previous licence; contain fee payment obligations no less favourable than those provided for in the previous licence; and not derogate from the allocations and rights to radio frequency or numbers provided for in the previous licence. (5) At a date six months from the commencement date of this Act, licences issued under the repealed Acts, shall cease to be valid and enforceable and the licence holder shall not have any right to compensation in this regard. 2. The Board of the Authority appointed under the repealed Acts shall continue in operation for a period of three months from the commencement ofthis Act after which the Minister shall appoint new members in accordance with the provisions of this Act. (1) For the avoidance of doubt, a person who, before the Staff of commencement of this Act, was an officer or employee of the Authority Authority, shall continue to be an officer or employee of the Authority, as the case may be, as if appointed or employed under this Act. The service of the persons referred to, in subparagraph (1) shall be treated as continuous service. Nothing in this Act, affects the rights and liabilities of any person employed or appointed by the Authority before the commencement of this Act.
