(5) Where the licensees are unable to resolve a dispute in
accordance with subsection (2) or are unable to agree on whether
to mediate, arbitrate or litigate in accordance with subsection (3)
and such matter is referred to the Authority for resolution, the
Authority shall investigate the dispute and within thirty days of
the filing of the dispute, determine as to whether the parties have fulfilled their obligations under
subsection (2); and
ifthe parties have fulfilled their obligations, whether the
dispute will be heard by the Authority.
(6) The Authority shall determine a dispute provided for in
subsection (5) in accordance with the dispute resolution procedures
stipulated in the guidelines issued by the Authority.

(7) Arbitration under this section shall be done in accordance
with the Arbitration Act, 2000.

ENFORCEMENT AND OFFENCES

Telecommunication
officers

76. (1) In order to ensure compliance with the provisions of
this Act and the terms and conditions of any licence or assignment,
the Authority shall carry out inspections and may appoint such
telecommunications officers as may be necessary for that purpose.
A telecommunications officer shall be provided with a
certificate of appointment which shall be prima facie evidence of
the telecommunications officer's appointment as such.
Any telecommunications officer or police officer carrying
out any functions under this Act shall on demand by any person
who is affected by the telecommunications officer's exercise of
power, produce for inspection the certificate referred to in
subsection (2).
A telecommunications officer shall have the power, on
production ofthe certificate of appointment issued under subsection
(2), to demand the production of, and to inspect or make copies of
a licence or assignment issued under this Act, or any agreement
concluded, or accounts kept, pursuant to the provisions of this
Act.
A telecommunications officer may, upon probable cause
shown on oath to a magistrate court, obtain a warrant to enter
upon and search or examine the premises prescribed in the
warrant in order to ascertain whether any offence is being or has
