Information and Communication Technologies [No. 15 of 2009 165 PART VIII UNIVERSAL ACCESS AND SERVICE 70. (1) There is hereby established the Universal Access and Service Fund which shall be used for the financing of universal access and service. The Authority shall determine a system to promote the widespread availability and usage of electronic communications networks and services throughout Zambia by encouraging the installation of electronic communications networks and the provision of electronic communications services in un-served or under-served areas and communities. A determination by the Authority under subsection (1) shall include definitions of 'un-served areas', "under-served areas" and "under-served communities", and in determining such definitions, the Authority shall have regard to— the level of competition in particular areas or places; the availability of services in particular areas or places; the availability of services to any group; the commercial viability of installation of electronic communications networks or providing electronic communications services in particular areas or places; and (e) any barriers to the use of available services. (4) The Minister may, on the recommendation of the Authority, make regulations on universal access or service, which regulations may include— the nature and status of the Fund; the sources of funding and the manner will be paid; in which the Fund the internal organisation of the Fund and its relation with other entities; the activities that the Fund shall finance and the manner in which such financing shall occur; (e) the annual contributions payable by any licensee to the Fund, that shall not exceed the amount prescribed by the Minister, in consultation with the Authority; and Universal Access and Service Fund
