140 No. 15 of 2009i Information and Communication Technologies A person who, without a certificate of competence, operates an amateur radio station, or has possession or control of such a radio station, commits an offence. A person convicted of an offence under this section is liable to a fine not exceeding three hundred thousand penalty units or to imprisonment for a term not exceeding three years, or to both. Suspension or revocation of licence or certificate 37. (1) The Authority may suspend or revoke a licence or certificate of competence if the holder thereof is in default. (2) For the purposes of this section, a licensee or a person who holds a certificate of competence is in default if the licensee or person-(a) has contravenedthe conditions of the licence or certificate; any provision of the guidelines issued by the Authority; or (Hi) any provision of this Act; or (b) has been the subject of such complaints by the public as, in the opinion of the Authority, warrants action under this section. (3) Where a licensee or a holder of a certificate of competence is in default, the Authority may— by notice in writing to the holder of the licence or certificate, suspend the licence or certificate for a period not exceeding twelve months; by notice in writing, revoke the licence or certificate; or (c) refuse to renew the licence or certificate on its expiry. (4) Without limiting the generality of subsection (3), the Authority may revoke or refuse to renew a licence on the ground that— (a) the radio station in respect of which the licence was issued, or the radio station apparatus used in connection therewith-interferes with the operation of a radio station or the carrying on of any established radiocommunication or telephone or telegraph services; or is likely to interfere with established radio station apparatus or other equipment, circuits, wires or the like; or
