3.2 Broadcasting is regulated by an independent body
adequately protected by law against interference
whose board is appointed - in an open way - involving civil society and not dominated by any particular
political party.
On paper, the Broadcasting Regulator (HCA) exists by virtue of article 11 of the
Ordinance of 1992 but in practise this is not the case. By virtue of article 12 of this
same Ordinance, the composition of the HCA is ruled by decree, there is however,
to this day, no decree signed to that effect. All this while the HCA has been based
in the Ministry of Communication, which is not quite a pledge of independence.
Moreover, the Minister who presides over the Commission nominates members10
personally.
