3.3 The body, which regulates broadcasting services
and licenses, does so in the public interest and ensures
fairness and a diversity of views broadly representing
society at large.
The awarding of broadcasting licenses is done by means of tender. The HACA
manages everything in reference to the rules of law no. 2004-644 of 14
December 2004 on the judicial regime on audio-visual communications, modified
by regulation no. 2011-474 of 21 December 2011 and the decrees of application
of 29 February 2012.
For example, to create a radio station, the authorisation of the use of frequencies
by private commercial radio stations and non-commercial private radio stations
are given respectively, following the launch of a tender process and a call for
candidacies. A security deposit is applicable – for which a fixed amount, by decree,
is set at 400.000.000 FCFA (USD 683.803) for private commercial radio stations
and 3.000.000 FCFA (USD 5.128) for non-commercial private radio stations.
