Broadcasting regulation is transparent
and independent; the State broadcaster
is transformed into a truly public
broadcaster.
3.1 Broadcasting legislation has been passed and is implemented that provides for a conducive environment
for public, commercial and community broadcasting.
Despite the existence of the law no. 2004-644 of 14 December 2004 governing
audio-visual communication – which is the applicable broadcasting legislation –
panellists noted that it is only partially applied. Panellists pointed to restrictions on
community radio stations, which limit their advertising revenue to only 20% of
their turnover. In addition, the statutes of the law are poorly defined.
With regards to public broadcasting, RTI reserves its status as the sole state media.
Panellists pointed out that Article 106 of the 2004 law is very clear on the role
of the RTI in this regard, stipulating that: “public sector bodies in audio-visual
communication follow a public service mission in the general interest.”
