1.11 Media legislation evolves from meaningful consultations among state institutions, citizens and interest groups.
The drafting of media legislation is not necessarily the result of in-depth
consultations with institutions, citizens and/or interest groups. In most cases,
the basic work is done by a foregone agreement. But one panellist underlines
that this can change from one day to the next. For example, in the drafting of
the twin laws of 2004 on the press and on broadcasting, it was suggested that
managers of publications and newspapers should be professional journalist. This
suggestion, however, was not incorporated into the final law. Panellists noted
that although some consultation may take place, the definitive version of a law
does not necessarily provide the anticipated result.
