Broadcasting regulation is transparent and independent, the state broadcaster is transformed into
a truly public broadcaster

Broadcasting is regulated by an independent body adequately protected against interference, particularly
of a political and economic nature.

ANALYSIS:
As described under indicator 2.4, the Ministry of Information and
Communication is issuing permits for broadcasting and the Kenya
Communications Commission, appointed by the minister, allocates
frequencies. There is no independent regulatory body.

The appointments procedure for members of the regulatory
body is open and transparent and involves civil society.

ANALYSIS:
A provision in the KCC Act says that 4 members of the board be
appointed from civil society. The appointments are made by the
minister and experience shows that the people chosen are well connected to top politicians. Civil society at large is not entitled to
propose or nominate candidates.
