Broadcasting regulation is transparent
and independent; the state broadcaster
is transformed into a truly public
broadcaster.
3.1
Broadcasting legislation has been passed
and is implemented that provides for a conducive
environment for public, commercial and community
broadcasting.
Both Law 002 of 2010, in its articles 27 to 41, and Law 003, which establishes
the High Communication Authority (Haute Autorité de la Communication, HAC),
contain provisions for opening up the broadcasting sector and promoting public,
commercial and community broadcasting. According to article 27, paragraph 2
of Law 003 the HAC, an independent body, is authorised to license private radio
and television stations and community radio stations.
At present, 46 licences have been granted and 23 radio stations are actually on air,
in addition to two private and two public television stations.
Concerning community broadcasting, some panelists thought that the law is not
being fully applied. Indeed there is a need to clarify the status of community radios
as some have the status of public and others of private radio stations.
