The Cybersecurity and Data Protection Bill was enacted into law on the 3rd of December 2021 as
the Cyber and Data Protection Act. MISA Zimbabwe produced an analysis of the Act which can be
accessed on this link.
The enacted Act has progressive elements which had been advocated for by MISA Zimbabwe.
For example, it has a section which specifically lays out the rights of data subjects, specification
of notice periods in the event of a security breach and also an obligation on the Data Protection
Authority to put in place regulations that should govern the whistleblowing system guided by
principles that include fairness and lawfulness.

Cellphone Levy
On the issue of internet access and affordability, MISA Zimbabwe also raised concerns with a cellphone
levy of USD50.00 that was proposed in the 2022 National Budget by the Minister of Finance Professor
Mthuli Ncube. This levy would have made the purchasing of mobile phones even more expensive and
thus further hampering exercise of digital rights as smart phones are an enabler for access to digital tools
and platforms.
