by law and/or the courts.
In Tanzania, there is no statutory guarantee of the protection of confidential
sources of information. The constitution and media-related laws are silent on this,
while existing laws can compel the disclosure of sources, such as The National
Security Act (1970), The Prevention of Terrorism Act (2001) and the Prevention
and Combatting of Corruption Act (2007)
An early draft of the Media Services Bill contained a clause related to the protection
of sources, following input from media stakeholders, but this was not in the
subsequent draft Media Services Act, which was published in the Government
Gazette in February 2015.
Until now, no one has ever been prosecuted for failing to divulge their confidential
sources of information and as such no precedence in this regard has been set in
a court of law.
