Broadcasting regulation is
transparent and independent; the
state broadcaster is transformed into
a truly public broadcaster.
3.1
Broadcasting legislation has been passed
and is implemented that provides for a conducive
environment for public, commercial and community
broadcasting.
The Broadcasting Act of 1998 subscribes to the three tiers of broadcasting: public,
commercial and community. However, a draft Broadcasting Policy has yet to be
passed and no regulations have been implemented in this regard. Due to the lack
of an implementing framework, the legislation concerning public and community
broadcasting is on hold.
State broadcasting is operated as an organ of government and thus is not under
the jurisdiction of the National Broadcasting Board (NBB), which only has the
power to license private broadcasters.
Government officials have previously argued that community broadcasting could
be used to divide the country, as was the case with radio in the Rwandan genocide.
