Adequate competition legislation/regulation
seeks to prevent media concentration and monopolies.
A law governing competition was passed in 2010 and the Competition
Commission was to be established during June 2011 (around the time of writing
this report.) Advertisements for the position of Competition Commissioner have
already been published.
There appears to be some secrecy around the Competition Act, or at least a lack
of publicity, as the participants were unclear about its contents and the impact of
the Act on media entities.
“If it is to be adequate, there should have been consultation with the industry, but
this did not happen.”
There have been no legal cases relating to media concentration, although a number
of private media houses do have multiple interests. Mmegi, for example, has
interests in broadcasting, print, publishing and distribution.
