1.7 Public information is easily accessible, guaranteed
by law, to all citizens.
The panellists recall some of the different laws establishing and organising the
access of citizens, including journalists, to public information: Law 2006-19 of
30 June 2006 relating to archives and administrative documents and Law 96-04
of 22 February 1996, respectively. But they reveal at the same time that there is
no mechanism enabling the enforcement of the relevant legal and regulatory
provisions. In particular, the committee on access to administrative information
and protection of personal information, provided for in Article 25 of Law 200619, has still not been set up, for lack of an implementing decree.
Nevertheless, the panel recognises that the government authorities have
demonstrated a political will to make public information available to citizens. This
will is evident in the authorities’ agreeing to civil society initiatives for the adoption
of a law on access to information and in the new government’s declarations
advocating virtuous and transparent governance.
