Average score: 1.1 (2007=1.7) 2.5 Adequate competition legislation/regulation seeks to prevent media concentration and monopolies Officially, the law does not allow media concentration and monopolies according to article 6 of the organic law on the HAAC. Article 6 stipulates:“The Higher Broadcasting and Communication Authority, as the guarantor of freedom of the media and communication: - ensures equal treatment of all operators in the media and communicationfield; proposes for nomination by the Head of State during Cabinet Meeting, the directors of state media houses; guarantees the autonomy and impartiality of public information and communication services; ensures the safeguarding of the national cultural identity by appropriately monitoring the opening of communication means on the market; ensures that free competition is encouraged and promoted; ensures the quality and diversity of programmes, the development of production and national broadcasting creativity as well as the enhancement of national and universal cultural heritage; prevents media concentration in order to maintain the pluralistic nature of information and communication; may make suggestions relating to training in the media and communications field; AFRICAN MEDIA BAROMETER BENIN 2009 87
