3.3 The body, which regulates broadcasting services
and licences, does so in the public interest and
ensures fairness and a diversity of views broadly
representing society at large
Broadcasting authorisations and frequencies are issued by the HAAC. According
to the members of the panel, the awarding process is corrupt and highly
politicised. Some private companies (such as Sikka TV) have applied unsuccessfully
for an authorisation. During the same period, requests from people close to the
government have been approved, although so far, some promoters who have
received their authorisations have not put in place the necessary means (several
years later) to use the frequencies awarded to them.

3.4 The state/public broadcaster is accountable to the
public through an independent board which is
representative of society at large and selected in
an independent, open and transparent manner
ORTB is governed by law no 94-009 of 28 July 1994, relating to the establishment,
organisation and functioning of social, cultural and scientific bureaus or agencies;
law no 92-021 of 21 August 1992, creating the HAAC and Decree no 2005-252
of 6 May 2005 relating to its statutes. It is a legal entity, financially independent
and is under the supervision of the Ministry of Communication.
According to Article 7 of the law on the establishment, organisation and
functioning of social, cultural and scientific bureaus, each bureau is administered
by a board of directors. This board of directors is composed of a minimum of
seven and a maximum of 15 members, depending on the specific nature of the
bureau. These members are appointed by a decree of the Council of Ministers.
The representative of the overseeing minister acts as the chair of the board of
directors.
