Information and Communication Technologies [No. 15 of 2009 175 FIRST SCHEDULE (Section 4) ADMINISTRATION OF AUTHORITY PART I THE BOARD OF THE AUTHORITY 1. (1) There is hereby constituted the Board of the Authority which shall be the governing body ofthe Authority and shall exercise and perform the powers and functions of the Authority. (2) The Board shall consist of the following nine members appointed by the Minister: one representative each from the Ministries responsible for information and communications technology and home affairs; one member from an agency responsible for national security; a representative of the Attorney General; one person nominated by the National Farmers Union; one person nominated by the Zambia Consumers Protection Association; one person nominated by the Law Association of Zambia; one person nominated by the Engineering Institution of Zambia; one person nominated by a trade union representing staff employed by the Company; and (i) one other person appointed by the Minister. (3) TheMinister shall, on receiving the names of the proposed representatives under subsection (2), consider the nominations and may reject any nomination: Provided that where the Minister rejects any prosed representative, the Minister shall direct the .organisation or institution which proposed the representative to avail the Minister with the name of another representative. The Director General of the Authority shall be an ex-officio member of the Board and the Secretary to the board. A person shall not be nominated or appointed as a member of the Board if that person— has been convicted of an offence under any law; is a Member of Parliament or an officer or employee of a local authority; is an office bearer or employee of a political party; has a direct or indirect financial interest in the sector; or (e) is an immediate family member of a person referred to in paragraphs (c) and (d). (6) The Minister shall appoint the Chairperson and the ViceChairperson from among the members. Board of Authority
