The panel recognises that, in the law, the independent nature of the National Audiovisual Regulatory Board (CNRA) suffers from no ambiguity. This essential feature is clearly stated in the first Article of Law 2006-04, which brings the structure into being: “An independent authority regulating the broadcasting sector called the Conseil National de Régulation de l’audiovisuel (CNRA) is created”. Moreover, both in its present form and in its previous forms and compositions (Supreme Council of Radio and Television (HCRT); Supreme Audiovisual Council (HCA)), the members of the regulatory authority have always been very attached to their independence, according to the testimony of panellists who have previously served on the body. All agree that there is no political grip over the CNRA. But this independence is partially called into question by some members of the group who wonder about the selection procedure of members of the board. Indeed, the members of the CNRA were allegedly proposed to the head of state – for appointment – by the chairperson of the board, following private and individual consultations instead of consultations with the representative professional organisations.
