All international fundamental principles and human-rights-related instruments ratified by Congo are by law part of the constitution of the country4. By extension, regional and international instruments like the Declaration of Principles on Freedom of Expression in Africa are constitutionally part of the internal laws of Congo and thus enforceable. The freedoms enshrined in the constitution have also been largely drawn from these international and regional instruments. But, as already pointed out, they are not fully implemented. In addition to the ineffectiveness of past policies that granted few freedoms, the Congolese media and public have not tested the applicability of such international instruments in court. In general, there is little public knowledge of international instruments and the freedoms and rights that such instruments grant. Journalists and advocacy groups also claim that the government is making no effort to educate the public on the existence such instruments.
